Disclaimer
Last updated · 2026-05-09
This Disclaimer applies to all content, products, and services offered by Astropark Trading Services ("Astropark", "we", "us") on the website https://astropark.xyz and through any related channel (email, Telegram bot, TradingView publisher account). It supplements the Terms of Service and the Refund Policy.
By accessing the site, purchasing any product, or otherwise using our content, you confirm that you have read, understood, and accepted this Disclaimer.
1. Trading risk warning
Trading and investing are risky. Many will lose money in connection with trading and investing activities.
Only trade with capital you can afford to lose. Leverage and derivative products (futures, perpetuals, margin trading) can amplify losses beyond the initial deposit. Cryptocurrency markets, in particular, are highly volatile and may move in directions that no historical data can predict.
You are solely responsible for evaluating whether any indicator, strategy, or educational content offered by Astropark is suitable for your goals, risk tolerance, financial situation, and tax position. If you are unsure, consult a licensed financial advisor before making any investment decision.
2. Not financial advice
All content on this site — indicators, strategies, lessons, webinars, freelance deliverables, blog posts, social-media content, and any communication via email, Telegram, or any other channel — is provided for educational and informational purposes only.
Nothing on the site or in our content:
- constitutes a recommendation to buy, sell, hold, or trade any financial instrument;
- constitutes personal investment advice tailored to your financial situation;
- constitutes a solicitation, offer, or invitation to engage in any trading activity;
- constitutes legal, tax, accounting, or regulatory advice.
Astropark Trading Services is not registered as an investment firm with CONSOB, the European Securities and Markets Authority (ESMA), or any other financial supervisory authority. Astropark Trading Services is not authorized as an investment firm under MiFID II (Directive 2014/65/EU) or Italian Legislative Decree 58/1998 ("TUF"). We do not offer or provide investment advice (consulenza in materia di investimenti), portfolio management (gestione di portafogli), order execution or transmission services, or any other service requiring authorization under EU or Italian financial-services law.
We do not have access to your trading account, do not execute trades on your behalf, and do not custody your funds.
3. Past performance and hypothetical results
Past performance is not indicative of future results. This applies to: live track records, backtest results, hypothetical signals, equity curves, win-rate statistics, drawdown figures, and any other historical metric displayed on the site or in marketing material.
The performance results shown on product pages and marketing material are typically hypothetical and based on historical backtesting. They are not the result of actual trading. Hypothetical or simulated performance results have inherent limitations:
- unlike an actual performance record, simulated results do not represent actual trading;
- because the trades have not been actually executed, the results may have under- or over-compensated for the impact (if any) of certain market factors — including, but not limited to: liquidity, slippage, fees, funding rates, partial fills, order execution timing, and exchange downtime;
- hypothetical trading programs are designed with the benefit of hindsight (look-ahead bias is a constant risk despite our best efforts to avoid it);
- no representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
Where backtest results are shown without an explicit hypothetical-performance notice next to them, this Disclaimer applies in full and the results must be read as hypothetical. (Adapted from U.S. CFTC Rule 4.41 and ESMA Q&A 2018 on marketing communications under MiFID II.)
4. No guarantees, no warranty, services "as-is"
To the maximum extent permitted by mandatory consumer protection law, our services and content are provided "as is" and "as available" without any representation, warranty, or condition of any kind, whether express or implied.
In particular, we do not guarantee, represent, or warrant that:
- your use of our services will be uninterrupted, timely, secure, or error-free;
- any signal, alert, or indicator output will be accurate, complete, or delivered within a specific time;
- the indicators, strategies, or educational content will produce profitable results;
- any market data displayed on the platform is identical to that of any third-party source — data may differ from other charting or brokerage platforms due to differences in data vendors, time-stamping, rounding, corporate-action handling, or execution-model assumptions;
- alerts (e.g. on TradingView, Telegram, email) will be delivered without delay, interruption, or technical failure.
This clause does not affect, and is not intended to limit, the statutory warranty of conformity that consumers domiciled in the EU/EEA enjoy under Articles 128–135-quaterdecies of the Italian Consumer Code (transposing Directives 2019/770 and 2019/771). Where mandatory consumer protection law gives you a stronger right, that right applies.
5. Third-party platforms, data, and trademarks
5.1 — TradingView
TradingView® is a registered trademark of TradingView, Inc. Astropark Trading Services has no affiliation with TradingView, Inc. beyond being a publisher of indicators and strategies on the TradingView platform. Use of the TradingView platform is governed by TradingView's own Terms of Use and Privacy Policy, available at tradingview.com.
We do not control TradingView's pricing, availability, performance, data quality, or service interruptions. Any TradingView-side issue (e.g. inability to access the platform, removal of a script, change in policy) is outside our responsibility.
5.2 — Market data
Market data displayed on the platform may include data licensed from third parties or sourced from public exchanges. All data is provided "as is" and should be independently verified before being used for any trading decision. We are not liable for inaccuracies, delays, or omissions in third-party data, nor for any decision made in reliance on such data.
5.3 — Payment processors
Payments are processed by third-party providers (Stripe, PayPal, and — when available — crypto payment processors). Each provider has its own terms, privacy policy, and dispute-resolution procedures, which apply to the payment leg of your transaction. Astropark Trading Services does not store payment-card data and does not control the providers' service availability.
5.4 — External links
Our content may include links to third-party websites for educational or reference purposes. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, accuracy, or privacy practices of third-party sites.
6. Limitation of liability
To the maximum extent permitted by law, Astropark Trading Services is not liable for:
- trading losses, missed opportunities, taxes, or any consequence of your trading or investment decisions;
- losses arising from delays, interruptions, or failures of third-party platforms (TradingView, Stripe, PayPal, Telegram, exchanges, internet service providers);
- losses arising from your failure to keep account credentials confidential, or from misuse of the products by you or third parties acting on your behalf;
- losses arising from your reliance on hypothetical or backtest performance figures (which are subject to the disclosure in §3 above).
Our total liability arising from or related to the contract is capped at the amount you paid Astropark in the 12 months preceding the claim, except for liability that cannot be limited or excluded under mandatory law (e.g. fraud, gross negligence, death or personal injury caused by negligence, or rights granted to consumers under Articles 33–34 of the Italian Consumer Code).
7. Cryptocurrency-specific disclaimer
If you trade or hold cryptocurrencies (including stablecoins like USDC):
- crypto markets operate 24/7 and can move violently outside traditional market hours;
- on-chain transactions are irreversible — a wrong address or amount cannot be reversed;
- exchanges, custodians, and stablecoin issuers carry counterparty risk independent of our products;
- regulatory frameworks for crypto-assets are evolving (e.g. EU MiCA — Reg. (EU) 2023/1114 — applicable from 30 December 2024); your tax and legal obligations depend on your country of residence.
Astropark Trading Services is not a Crypto-Asset Service Provider (CASP) under MiCA. We do not custody crypto-assets, do not offer exchange or transfer services, and do not provide investment advice on crypto-assets.
8. Forward-looking statements
The site may contain forward-looking statements about markets, technologies, or our products (e.g. "this strategy is expected to perform well in trending markets"). Forward-looking statements are based on assumptions and are subject to risks and uncertainties. Actual outcomes may differ materially. We undertake no obligation to update any forward-looking statement.
9. Updates to this Disclaimer
We may update this Disclaimer from time to time. The "Last updated" date at the top will be revised. Material changes will be notified to registered users by email at least 15 days before they take effect.
