Terms of Service

1. Provider identification (art. 12 d.lgs. 70/2003)

The site is operated by:

• Astropark Trading Services ("Astropark", "we", "us")
• Contact email (general / privacy / GDPR): astroparktrading@gmail.com

Astropark operates as a professional ("professionista") within the meaning of Art. 3 of Italian Legislative Decree 206/2005 (Italian Consumer Code, "Codice del Consumo").

2. Acceptance of Terms

These Terms form a legally binding agreement between you and Astropark. You confirm that:

• you are at least 18 years old and legally capable of entering into binding contracts under the law of your country of residence;
• the information you provide at registration and checkout is accurate and current;
• you accept these Terms in their entirety, together with the Privacy Policy, the Refund Policy, the Cookie Policy, and the Disclaimer.

3. Account registration

3.1 Creating an account is required to purchase any product. You are responsible for keeping your password confidential and for all activity under your account.

3.2 One person, one account. Sharing or selling credentials is prohibited and may result in suspension or termination without refund.

3.3 You may provide an optional TradingView handle so we can grant access to invite-only scripts, and an optional Telegram user ID to use the support bot. Both are voluntary.

3.4 You may close your account at any time from Account → Settings → Delete account. Closure does not refund prior purchases (subject to the Refund Policy) and does not erase data Astropark is legally required to retain (e.g. tax records).

3.5 You agree not to abuse the 14-day money-back guarantee on indicators and strategies (see §6.2 and Refund Policy). Repeated refund requests by the same customer (3 or more in any 12-month period) may be considered "refund abuse" and result in suspension of the account and refusal of future orders, without prejudice to any refund already made.

If you choose to link the Astropark Telegram bot to your account, you agree to the Telegram Terms of Service as applicable to bot users and to additional processing of your Telegram user_id and bot conversation history as described in §11 of our Privacy Policy. Linking the bot is optional; you can unlink at any time from Account → Integrations or by sending /stop to the bot.

4. Products and services offered

Astropark sells digital products and services in the following categories. Each product page describes the essential characteristics of the product (art. 49 c. 1 lett. a Cod. Cons.) including price, delivery method, and any subscription terms.

4.1 — TradingView Indicators and Strategies (digital content)

• Pine Script v5 indicators or strategy scripts published on TradingView and made accessible to your TradingView account by Astropark adding your handle to the script's whitelist.
• Delivery: typically within 24 hours of payment (often within minutes via API; up to 48 hours on weekends or for manual review). Confirmation by transactional email (tv_invite_email).
• License: personal, non-transferable, non-exclusive license to use the indicator in your own TradingView account. You do not acquire ownership or any right to redistribute, resell, sublicense, modify, or reverse-engineer the script.
• Pricing: lump-sum (€4.99–€399), monthly subscription (€29.99/month), or lifetime (€399).

4.2 — Premium Trading Access (€100/month or €999/year)

• Continuous-access subscription granting use of all indicators and strategies in the catalog for the duration of the subscription.
• Service nature: a digital service with continuous performance (Italian Consumer Code, artt. 135-octies and following — implementing Directive (EU) 2019/770).
• Auto-renewal: monthly subscriptions auto-renew at the then-current rate. You may cancel any time from Account → Subscriptions. Cancellation stops future renewals; access continues to the end of the current paid period (no pro-rata refund unless required by law).
• Reminder: 7 days before each monthly renewal we send a courtesy reminder email with the next charge amount and a one-click cancel link.
• Price changes: at least 30 days' written notice. If you do not accept the new price, you may cancel before the next renewal at the old price.

4.3 — Webinars (1:1 service)

• Personal one-to-one sessions with the founder, delivered via Zoom or Telegram, ranging from €49.99 to €499 depending on duration and content.
• Delivery: scheduled at a date and time agreed at checkout, with confirmation email and calendar invite. Reminder emails at T-24h and T-1h.
• Withdrawal right: see §6.2 below.

4.4 — Custom freelance development

• Bespoke services (code review, proof-of-concept, custom development) ranging from €199 to €4,999.
• Personalized goods within the meaning of Art. 59 c. 1 lett. c) Cod. Cons. — once you confirm the order and the kickoff brief, the work is non-refundable because it is being developed specifically for you.
• A kickoff brief documenting your specifications is sent within 48 hours of order. The full scope is then governed by the Statement of Work signed before development begins.

4.5 — Free educational content

• Free articles, lessons, and (in the future) blog posts. No payment, no contract beyond these Terms.
• Provided as-is, for educational purposes only. See §9 for the financial-advice disclaimer.

5. Maximum delivery time (art. 61 Cod. Cons.)

Unless otherwise agreed in writing, Astropark commits to delivering the product or starting the service within 30 days of payment confirmation. If we cannot meet this deadline, you may set an additional reasonable period in writing; if we still fail, you may terminate the contract and obtain a full refund within 14 days. For digital products and TradingView script access, actual delivery is typically within 24 hours.

6. Right of withdrawal (consumer 14-day cooling-off)

The following applies to consumers domiciled in the EU/EEA. Customers in the UK, Switzerland, and other jurisdictions retain any rights granted by their local mandatory consumer protection law.

6.1 — General rule (art. 52 Cod. Cons.)

You have the right to withdraw from the contract within 14 calendar days without giving a reason, by notifying us via:

• the standard withdrawal form available at /legal/refund/form;
• a clear written statement to astroparktrading@gmail.com;
• any unequivocal communication identifying the order and your wish to withdraw.

Approved refunds are processed via the original payment method within 14 days of our receipt of your withdrawal notice (art. 56 Cod. Cons.).

6.2 — Application by product category

Full conditions are in the Refund Policy.

6.2.1 — Indicators and strategies — full 14-day money-back guarantee

Astropark voluntarily grants the full 14-day right of withdrawal without invoking the digital-content exception of art. 59 c. 1 lett. o). You may obtain a full refund within 14 days from purchase regardless of whether you have already used the indicator or strategy. When you exercise withdrawal, your TradingView handle is immediately removed from the script's whitelist.

6.2.2 — Premium Trading Access — withdrawal extinguished upon first access (art. 59 c. 1 lett. o)

Premium is a continuous-access digital service. At checkout you will be asked to expressly consent to immediate performance of the service before the end of the 14-day period and to acknowledge that you will lose the right of withdrawal once Astropark begins to provide the service. Before access begins (or if the consent checkbox is not ticked) you retain the full 14-day right and may withdraw with full refund. If you exercise withdrawal after access has started but within the 14-day period (only possible if the consent checkbox above has not been ticked), you owe a pro-rata amount for the period of access already enjoyed (art. 57 c. 3 Cod. Cons.).

6.2.3 — Webinars — withdrawal extinguished upon full performance (art. 59 c. 1 lett. a)

For webinars scheduled more than 14 days after the date of purchase you retain the full 14-day right of withdrawal. For webinars scheduled within 14 days, at checkout you will be asked to expressly request immediate-period delivery and acknowledge that — once the webinar is fully performed — the right of withdrawal is extinguished.

6.2.4 — Freelance / custom development — withdrawal extinguished upon kickoff (art. 59 c. 1 lett. c)

Freelance services are personalized to your specifications. The right of withdrawal is extinguished at the moment Astropark shares with you the kickoff brief documenting your specifications (typically within 48 hours of order). Before that moment, you may obtain a full refund within 14 days.

6.3 — Durable medium confirmation (art. 51 c. 7 Cod. Cons.)

For each of the categories §6.2.2, §6.2.3 (within 14gg) and §6.2.4, you will receive a transactional email confirming your express consent and the consequences for the right of withdrawal before the service starts. This email is the durable-medium confirmation required by law.

6.4 — Standard withdrawal form

A model withdrawal form (per Annex I, Part B, Cod. Cons.) is available at /legal/refund/form.

7. Pricing, payment, taxes

7.1 Prices are displayed in EUR and include all applicable taxes unless stated otherwise. For business customers (B2B) requiring a VAT-compliant invoice, please contact us before purchase.

7.2 Payment methods: Stripe (cards), PayPal, USDC (when available, on Ethereum/ Solana). All payment data is processed by the payment provider; Astropark does not store card details.

7.3 For subscriptions the first charge occurs at order confirmation; subsequent charges occur on the renewal date.

7.4 If a payment fails, we will retry up to 3 times over 5 days. Persistent failure leads to suspension of access until payment is resolved.

7.5 Currency conversion for non-EUR payment methods is at the rate set by the payment provider; Astropark is not responsible for conversion fees charged by your bank or wallet.

7.6 (Forfettario only) Operations are not subject to VAT pursuant to Art. 1, paragraphs 54-89, Italian Law 190/2014.

8. Intellectual property and license

8.1 All Pine Script source, lesson content, webinar recordings, freelance deliverables, branding, and original site design are the property of Astropark or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 When you purchase an indicator or strategy, you receive a personal, non-transferable, non-exclusive, revocable license to use it in your own TradingView account. You do not receive any rights to the underlying Pine Script source code, nor any right to redistribute, resell, sublicense, or reverse-engineer obfuscated or invite-only scripts.

8.3 For freelance custom development, the resulting deliverable's IP rights are governed by the Statement of Work. Default position: code is licensed (not assigned) to the client for internal use only, unless the SoW expressly assigns ownership.

8.4 Astropark grants you a revocable license to access free content for personal, non-commercial use.

9. No financial advice — risk disclosure

9.1 Astropark Trading Services is not a regulated investment firm under MiFID II (Directive 2014/65/EU) or Italian TUF (d.lgs. 58/1998), is not registered with CONSOB, the European Securities and Markets Authority, or any other financial supervisory authority, and does not offer or provide:

• investment advice (consulenza in materia di investimenti);
• portfolio management (gestione di portafogli);
• order execution or transmission services;
• any other service requiring authorization under EU or Italian financial-services law.

9.2 All content on this site — indicators, strategies, lessons, webinars, freelance deliverables, blog posts, social-media content, and communications via email or Telegram — is provided for educational and informational purposes only. Nothing on the site constitutes a recommendation to buy, sell, hold, or trade any financial instrument; personal investment advice tailored to your situation; a solicitation, offer, or invitation to engage in any trading activity; or legal, tax, accounting, or regulatory advice.

9.3 Trading and investing are risky. Many will lose money in connection with trading and investing activities. Past performance, including backtest results and hypothetical signals, does not guarantee future results. You may lose part or all of your invested capital. Consult a licensed financial advisor before making any investment decision.

9.4 The backtest results displayed on product pages are based on historical data with assumptions about fees, slippage, and order execution. Hypothetical or simulated performance results have inherent limitations and may not reflect actual trading outcomes. 9.5 Astropark Trading Services does not custody client funds, does not execute trades on behalf of clients, and does not have access to your trading account. You retain full control of your trading decisions and capital.

9.6 TradingView® is a registered trademark of TradingView, Inc. Astropark Trading Services has no affiliation with TradingView, Inc. beyond being a publisher of indicators and strategies on the TradingView platform. Use of the TradingView platform is governed by TradingView's own Terms of Use and Privacy Policy.

10. Acceptable use

You agree not to:

• scrape, mass-download, or systematically extract content from the site, the indicators, or the educational material;
• resell, redistribute, sublicense, or otherwise make available any Astropark product to third parties;
• reverse-engineer, decompile, or attempt to extract the source code of obfuscated or invite-only scripts;
• circumvent any access control, license check, or rate limit;
• use the site to violate any applicable law, including trade sanctions, money-laundering rules, or financial-services regulation;
• impersonate another person or transmit malicious code, spam, or harmful content via our channels (forms, support, Telegram bot).

Violation may result in account suspension or termination, deactivation of TradingView access, and (in serious cases) civil action for damages.

11. Limitation of liability

11.1 Subject to the next paragraph, to the maximum extent permitted by law, Astropark's total liability arising from or related to the contract is capped at the total amount you paid Astropark in the 12 months preceding the claim.

11.2 Astropark's liability is not limited or excluded for: (a) death or personal injury caused by negligence, (b) fraud or gross negligence, (c) any liability that cannot be lawfully limited or excluded under mandatory consumer protection law (artt. 33-34 Cod. Cons.).

11.3 In particular, Astropark is not liable for:

• trading losses, missed opportunities, or any consequence of your trading decisions;
• service interruptions caused by TradingView, payment providers, or other third-party services beyond Astropark's reasonable control;
• losses caused by your failure to keep account credentials confidential.

12. Statutory warranty (legal guarantee of conformity)

12.1 As a consumer, you have the statutory warranty of conformity for digital products and services under Articles 128–135-quaterdecies of the Italian Consumer Code (Dir. 2019/771 + 2019/770). For digital content delivered as one-off (indicators, strategies) the warranty period is 2 years from delivery; for continuous-access subscriptions it lasts for the entire contract duration.

12.2 Remedies in case of non-conformity: (a) bringing the product into conformity, (b) proportional price reduction, (c) termination of the contract — in this order, subject to the conditions of the law.

12.3 To exercise these rights, contact us at astroparktrading@gmail.com within 2 months of becoming aware of the non-conformity.

13. Termination

13.1 You may close your account at any time per §3.4.

13.2 We may suspend or terminate your account, without refund, if you materially breach these Terms; engage in fraud or chargeback abuse; or behave abusively toward staff or other users.

13.3 On termination, paid access to subscriptions ends; lifetime licenses are forfeited only in cases of fraud or gross misconduct.

14. Modifications to these Terms

14.1 We may amend these Terms occasionally. We will update the "Last updated" date, notify registered users by email at least 30 days before any material change, and give subscribers the right to terminate before the change takes effect, without penalty, if it is materially adverse to them.

14.2 Continued use of the site after the change takes effect constitutes acceptance of the revised Terms.

15. Out-of-court dispute resolution — ODR / ADR

15.1 For consumer disputes you may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr (Reg. EU 524/2013).

15.2 You may also contact a recognized ADR body in your country of residence.

15.3 For disputes above €5,000 in Italy, a mandatory mediation attempt under d.lgs. 28/2010 must precede court action.

16. Governing law and jurisdiction

16.1 These Terms are governed by Italian law, without prejudice to the application of mandatory consumer protection rules of the consumer's country of habitual residence (Art. 6 Reg. EU 593/2008 — "Rome I").

16.2 For consumer disputes, the competent court is the court of the place where the consumer is domiciled, in accordance with Articles 17-19 of Regulation (EU) 1215/2012 ("Brussels I-bis") and Art. 33 c. 2 lett. u) Italian Consumer Code.

16.3 For non-consumer disputes (including B2B), the exclusive jurisdiction is that of the Court of [città IT — to be confirmed].

17. Severability and waiver

17.1 If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

17.2 Failure or delay by Astropark in enforcing any right under these Terms is not a waiver of that right.
